TERMS AND CONDITIONS OF USE – ICTLMS 

This platform (“https://taniilms.ictacademy.in/”) is owned and operated by FarmwiseAI, a company registered in India. The Platform is provided to ICT Academy for use by authorised institutions, students and faculty. By accessing or using the Platform, you agree to these Terms and Conditions of Use.

TERMS AND CONDITIONS OF USE – ICTLMS

1. Introduction

This platform (“https://taniilms.ictacademy.in/”) is owned and operated by FarmwiseAI, a company registered in India. The Platform is provided to ICT Academy for use by authorised institutions, students and faculty. By accessing or using the Platform, you agree to these Terms and Conditions of Use.

2. User Types

Users of the Platform may include:

• Student Users
• Faculty / Mentor Users
• Institution and Administrator Users
• Guest / Evaluation Users (if any)

3. Eligibility

Use of the Platform is allowed only for authorised users nominated by ICT Academy or participating institutions. Users must comply with their institutional rules and all applicable laws in India.

4. Scope of Use

The Platform is intended exclusively for academic and training-related activities, including project-based learning, mentoring, assessments and related administrative tasks. Commercial exploitation, unauthorised sharing of access credentials or use of the Platform for purposes not authorised by ICT Academy is strictly prohibited.

5. Ownership and Intellectual Property

The Platform software, AI-Generated content, AI Models, user interface, documentation and underlying technology are and shall remain the exclusive intellectual property of FarmwiseAI. All learning content and data provided or created by ICT Academy, participating institutions or faculty as part of the programme shall remain their property, unless otherwise agreed in writing. Users shall not copy, decompile, reverse engineer or attempt to derive source code from any part of the Platform, except as expressly permitted in writing.

6. User Account and Security

Users are responsible for maintaining the confidentiality of their login ID and password. Any activity carried out using a user’s credentials will be treated as having been carried out by that user. Users must promptly inform the support team or institution administrator if they suspect unauthorised access to their account.

7. Acceptable Use

Users agree not to:

• Upload, post or share any content that is illegal, abusive, defamatory, obscene, hateful or otherwise objectionable;
• Upload or distribute any files containing viruses, malware or malicious code;
• Attempt to circumvent or disable any security or access control systems;
• Misuse any AI or mentoring tools for non-academic, harmful or fraudulent purposes.

8. Third-Party Services and Links

The Platform may integrate third-party services (such as video streaming, cloud storage or code repositories) and may contain links to external websites. FarmwiseAI does not control and is not responsible for the content, availability or policies of such third-party services. Use of third-party services is subject to their own terms and privacy policies.

9. Availability and Changes to the Platform

FarmwiseAI will use reasonable efforts to keep the Platform operational and secure. FarmwiseAI reserves the right to modify, enhance, suspend or discontinue any part of the Platform, or to introduce new features, in consultation with ICT Academy where required.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the Platform is provided on a best-effort and “as is” basis. FarmwiseAI shall not be liable for any indirect, consequential, incidental, special or exemplary damages arising out of or in connection with the use or inability to use the Platform, except as may be expressly provided in the Master Service Agreement or Work Order between FarmwiseAI and ICT Academy.

11. Indemnity

Users agree to indemnify and hold harmless FarmwiseAI, ICT Academy and the participating institutions from any claims, damages, liabilities or expenses arising from their misuse of the Platform or violation of these Terms.

12. Termination or Suspension of Access

Access to the Platform may be suspended or terminated by the Institution Administrator, ICT Academy or FarmwiseAI in case of any misuse, security risk, breach of these Terms or end of the underlying project or programme. On termination, a user’s right to access and use the Platform shall immediately cease.

13. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at Chennai, Tamil Nadu, India.

 

PRIVACY POLICY – ICTLMS

1.Introduction

This Privacy Policy explains how FarmwiseAI (“we”, “us” or “our”) collects, uses, stores and protects personal data of users of ICTLMS (“Platform”). We comply with applicable Indian laws, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023, as notified and amended from time to time.

2. Roles of Client and Service Provider

For the purposes of this project:

·       ICT Academy acts as the Data Fiduciary, deciding the purposes and means of processing personal data of users; and

·       FarmwiseAI acts as the Data Processor or Data Service Provider, processing personal data only as per the documented instructions of ICT Academy.

3. Personal Data Collected

Depending on the specific configuration and modules enabled, the Platform may collect the following categories of personal data:

o   Basic identification data: name, email address, mobile number (if provided), institution name, student or employee ID;

o   Account data: username, encrypted password, roles and permissions;

o   Academic data: courses enrolled, attendance, assignments, projects, examination or assessment scores, feedback and certificates;

o   Usage data: login timestamps, pages visited, actions performed on the Platform, IP address and device or browser information;

o   Uploaded content: documents, project reports, source code, presentations and other files uploaded by users.

4. Purpose of Processing

Personal data is processed for one or more of the following purposes:

·       To create and manage user accounts and provide access to the Platform;

·       To enable project-based learning, mentoring, assessments and certification;

·       To generate dashboards, analytics and reports for students, faculty, institutions and the Client;

·       To maintain security, prevent misuse and monitor system performance;

·       To improve and customise the Platform experience in consultation with ICT Academy;

·       To comply with legal, regulatory or contractual obligations.

5. Lawful Basis and Consent

Most users access the Platform as part of a government or institutional programme, and processing is carried out based on such authorisation and contractual necessity. In certain cases, we may seek express consent for optional features (such as promotional communication or additional services). Users may withdraw consent for optional processing by contacting the designated officer, but some essential processing may be necessary for continued use of the Platform.

6. Cookies and Similar Technologies

The Platform may use cookies and similar technologies to enable login sessions, enhance security and understand usage patterns. For more details, please refer to the Cookie Policy of the Platform.

7. Data Sharing and Disclosure

Personal data may be shared only with the following categories of recipients:

§  ICT Academy and authorised institutions, for monitoring academic progress and programme performance;

§  Cloud infrastructure and hosting providers, preferably MeitY-empanelled, engaged under appropriate agreements;

§  Service providers for email, SMS, analytics or similar support functions, as approved by ICT Academy;

§  Government authorities, regulators or law enforcement agencies, when required under applicable law.

§  We do not sell personal data to any third party.

8. Data Storage, Location and Security

Personal data is stored on secure servers, preferably located within India, in line with client or government requirements. We implement appropriate technical and organisational measures such as encryption, role-based access control, audit logs and periodic security assessments to safeguard personal data.

9. Data Retention

Personal data is retained only for as long as necessary to fulfil the purposes described in this Policy, to comply with applicable legal or regulatory requirements, or as agreed with ICT Academy. Upon expiry of the retention period or termination of the project, personal data will be deleted or anonymised, subject to the instructions of ICT Academy.

10. User Rights

Subject to applicable law and the policies of ICT Academy, users may have the following rights in relation to their personal data:

·       The right to access their personal data;

·       The right to request correction of inaccurate or incomplete personal data;

·       The right to withdraw consent for optional processing, where consent is the basis;

·       Any other rights recognised under the Digital Personal Data Protection Act, 2023, as applicable through ICT Academy.
Requests to exercise such rights may be routed through the concerned institution or ICT Academy.

12. Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in legal requirements, technology or our practices. The updated Policy will be made available on the Platform, and the “Last Updated” date will be revised accordingly.

 

     

COOKIE POLICY – ICTLMS

1. Introduction

This Cookie Policy explains how FarmwiseAI uses cookies and similar technologies on ICTLMS.

2. What Are Cookies?

Cookies are small text files that are stored on your device when you visit a website or use an online service. They help the website recognise your device and remember certain information about your visit.

3. Types of Cookies We Use

We may use the following types of cookies on the Platform:

Essential Cookies: required for login, session management and security. The Platform cannot function properly without these cookies;

Preference Cookies (optional): used to remember your language or display preferences, where such options are enabled;

Analytics Cookies (if enabled): used to understand how users interact with the Platform so that we can improve its performance and usability.

4. How We Use Cookies

We use cookies to:

§  Keep you logged in while you navigate between pages;

§  Help secure your session and prevent unauthorised access;

§  Analyse usage patterns, generally in aggregated form, to improve the Platform.

5. Managing Cookies

Most web browsers allow you to control cookies through their settings. You may choose to disable cookies, but essential features of the Platform may not work properly if essential cookies are blocked.

6. Third-Party Cookies

If we embed content from third-party sites (such as videos or other tools), those services may place their own cookies on your device. Their cookie or privacy policies will apply to such cookies.

        

COPYRIGHT AND EXTERNAL CONTENT DISCLAIMER – ICTLMS

1. Ownership of Platform Content

Core Platform software, user interface, documentation and system-generated content belong to FarmwiseAI. Learning materials, project briefs and other academic content provided by ICT Academy, participating institutions or faculty belong to them, unless otherwise agreed in writing.

2. User-Uploaded Content

Students, faculty and other authorised users may upload project reports, code, data, presentations and other materials to the Platform. By uploading content, the user confirms that they have the necessary rights to use and share such content for academic purposes and that it does not violate any law or third-party rights.

3. External Links and Third-Party Resources

The Platform may link to or embed content from third-party sites (for example, YouTube, code repositories or public educational resources). FarmwiseAI does not claim ownership over such external content, does not control its availability, and is not responsible for its accuracy or completeness. Use of external resources is subject to the terms and policies of the respective providers.

3.1. Content Registry & External Resources The Platform maintains a 'Content Registry' indexing external links, blogs, and educational resources for the convenience of users. While FarmwiseAI endeavours to curate relevant academic resources:

  • No Endorsement: Inclusion in the registry does not constitute an official endorsement of the external website, its views, or its operators by the Government of Tamil Nadu or FarmwiseAI.
  • Dynamic Nature: External URLs may change, break, or be redirected to irrelevant content over time. We do not guarantee the continued validity or safety of links in the registry once they leave our domain.
  • User Caution: Users access registered external links at their own risk

3.2. Embedded Media & YouTube API Services The Platform may display embedded content (e.g., videos via YouTube API) for educational reference. By using the Platform, users acknowledge that:

  • Embedded content is subject to the terms of the hosting provider (e.g., YouTube Terms of Service).
  • FarmwiseAI does not own or control embedded third-party content.
  • If any embedded resource becomes unavailable or is taken down by the original creator, FarmwiseAI is not liable for its replacement.

 

4. No Guarantee of Accuracy

Learning resources, assignment materials and sample solutions on the Platform are provided for educational purposes and may not be exhaustive or error-free. Users are encouraged to exercise their judgement and verify critical information from reliable sources.

4.1 The 'AI Mentor' feature uses Large Language Models (LLMs) to assist students. The user acknowledges that AI can produce incorrect, biased, or outdated information ('hallucinations'). The AI Mentor is a support tool only and must not be treated as a replacement for official faculty or textbooks.

4.2 Hierarchy of Truth: In the event of any discrepancy between the information provided by the AI Mentor and the official syllabus/curriculum prescribed by the Department of Higher Education, Anna University, DOTE (Directorate of Technical Education), or the Tamil Nadu State Government, the official government curriculum shall always prevail. FarmwiseAI accepts no liability for academic errors resulting from reliance on the AI.

4.3. License Status of External Resources FarmwiseAI includes external links and resources believing them to be publicly available for non-commercial educational use. However, FarmwiseAI makes no representation or warranty regarding the specific license or permission status (e.g., Creative Commons, commercial use rights, or duration of availability) of content found on third-party sites.

Users, faculty, and the Client (ICT Academy) are expected to exercise due diligence and verify that their specific use of any external resource is in full compliance with the original creator's terms and any applicable third-party licenses before relying upon such content

5. Takedown and Complaints

If any content owner or user believes that material on the Platform infringes their rights or is otherwise inappropriate, they may report the issue to FarmwiseAI and/or ICT Academy. Upon receiving a valid copyright or violation notice from ICT Academy or a rights holder, FarmwiseAI shall review the complaint and, if the content is found to be infringing or non-compliant, remove or disable access to such content within Thirty (30) working days of receipt of the notice.

 

 

CONTENT UPLOAD POLICY – ICTLMS

1. Who Can Upload

Only authorised users, such as students, faculty, mentors, institution administrators and other users approved by ICT Academy, may upload content to the Platform.

2. Permitted Content

Permitted content includes academic project files, source code, data sets, documents, presentations, reports and learning materials that are directly related to the approved programmes or courses.

3. Prohibited Content

Users must not upload content that:
• Is illegal, obscene, defamatory, hateful or discriminatory;
• Violates intellectual property rights, privacy rights or any other rights of third parties;
• Contains viruses, malware or malicious code;
• Constitutes unauthorised advertising, spam or promotional material;
• Is unrelated to the academic or training objectives of the Platform.

4. Responsibility of Users

Users are responsible for ensuring that they have the right to upload and share the content they submit and that it complies with applicable law and institutional policies. Users should avoid uploading sensitive personal data unless explicitly required for academic purposes and approved by the institution.

5. Review and Removal

FarmwiseAI and ICT Academy reserve the right to review, restrict or remove any uploaded content that appears to violate this Policy, applicable law or institutional norms. Repeated violations may lead to suspension or termination of user access.

 

CONTENT MODERATION POLICY – ICTLMS

1. Objective

This Policy sets out how content on ICTLMS may be monitored and moderated to keep the Platform safe, lawful and suitable for students, faculty and other authorised users.

2. Primary Responsibility

Primary responsibility for academic content, including its quality and appropriateness, lies with ICT Academy, participating institutions and their faculty or administrators. FarmwiseAI provides technical tools and may assist in moderation as agreed.

3. Moderation Approach

Inappropriate content may be identified through:

§  Reports from users using the “Report” or “Help” features, or by email; and

§  Periodic reviews by institution administrators or the Client.
Where serious security or legal concerns exist, FarmwiseAI may also review content within the scope of applicable law and contractual obligations.

4. Actions on Violations

Depending on the nature and severity of the violation, possible actions include:

o   Removal or restriction of access to specific content;

o   Warning or counselling of the user;

o   Temporary or permanent suspension of user access, in coordination with the institution;

o   Escalation to ICT Academy or appropriate authorities where required by law.

5. Appeals and Clarifications

If a user believes their content has been wrongly removed or restricted, they may contact the institution or ICT Academy with an explanation. Reasonable efforts will be made to review such requests.

 

 

INFORMATION SECURITY AND DATA PROTECTION POLICY – ICTLMS

1. Hosting and Infrastructure

ICTLMS is hosted on secure infrastructure, preferably MeitY-empanelled cloud services located in India, in line with client or government requirements. Hosting providers are engaged under appropriate agreements to protect data confidentiality, integrity and availability.

2. Technical Security Measures

Key security measures include, as applicable:

·       Use of HTTPS or TLS for all web traffic;

·       Strong authentication and role-based access control;

·       Encryption of sensitive data at rest and in transit, wherever feasible;

·       Audit logs for key actions and security events;

·       Regular backups and a disaster recovery plan.

3. Organisational Measures

FarmwiseAI restricts access to personal and sensitive data to authorised personnel who require such access to perform their duties. Staff and contractors are bound by confidentiality obligations and are sensitised to data protection requirements.

4. Vulnerability Management

The Platform is periodically tested for vulnerabilities, and patches or updates are applied as needed. Where required by ICT Academy, vulnerability assessment and penetration testing (VAPT) may be performed by qualified or empanelled agencies.

5. Incident Management

Any suspected or actual security incident or data breach is logged, investigated and addressed promptly. Where the incident is likely to impact personal data or critical services, ICT Academy is informed without undue delay, and necessary steps are taken in line with applicable law and contractual commitments.

6. User Responsibilities

Users should follow good security practices, including keeping passwords confidential, logging out after use on shared devices and not sharing their accounts with others.

 

 

DATA RETENTION AND DELETION POLICY – ICTLMS

1. Purpose

This Policy explains how long data on ICTLMS is retained and how it is deleted or anonymised after the retention period, in coordination with ICT Academy.

2. General Principles

Data is retained only for as long as necessary to fulfil the agreed academic and administrative purposes, meet legal or regulatory requirements, and comply with directions from ICT Academy or relevant authorities.

3. Example Retention Periods

Subject to written agreement with ICT Academy, typical retention periods may be:
• User account and profile data: project or programme duration plus 1 year;
• Academic and assessment records: project or programme duration plus 1 year;
• System and security logs: at least 180 days, or longer where required.

4. Deletion and Anonymisation

After expiry of the relevant retention period, personal data will be securely deleted or anonymised, unless ICT Academy requests continued retention under law or policy. Where the underlying contract terminates, FarmwiseAI will hand over the required data to ICT Academy and delete its copies after confirmation, except where retention is mandated by law.

5. Backups

Backups may contain older copies of data and are retained for disaster recovery purposes. Such backups are stored securely and, when no longer required, are deleted or overwritten in the normal course of operations.

 

END-USER LICENCE AGREEMENT – ICTLMS

1. Licence Grant

Subject to these terms, FarmwiseAI grants each authorised user a limited, non-exclusive, non-transferable licence to access and use ICTLMS solely for academic and training-related purposes approved by ICT Academy or the relevant institution.

2. Restrictions

Users shall not:
• Copy, modify, distribute, sell or lease any part of the Platform;
• Attempt to reverse engineer, decompile or derive source code from the Platform, except to the extent that such restrictions are explicitly prohibited by law;
• Remove or alter any proprietary notices or disclaimers on the Platform.

3. Institutional Use

Access to the Platform is linked to the user’s association with the institution or programme. Where a user’s enrolment or employment ends, or where access is withdrawn by the institution or ICT Academy, the user’s licence to use the Platform automatically terminates.

4. Updates

FarmwiseAI may provide updates, enhancements or new features to the Platform. Unless otherwise specified, this Agreement will apply to such updates as well.

5. Termination

This licence will terminate automatically when user access is revoked by FarmwiseAI, ICT Academy or the institution, or when the underlying programme ends. On termination, the user must cease all use of the Platform.

ACCEPTABLE USE POLICY – ICTLMS

1. Purpose

This Acceptable Use Policy sets out the rules for using ICTLMS so that it remains a safe and effective environment for learning and collaboration.

2. General Responsibilities
Users should:

·       Use the Platform only for authorised academic or training-related activities;

·       Treat other users with respect and avoid any form of harassment or Ragging and bullying;

·       Comply with all applicable laws, institutional policies and instructions from faculty and administrators.

3. Prohibited Activities

Users must not:

·       Attempt to gain unauthorised access to other accounts or parts of the system;

·       Use the Platform to transmit or store unlawful, offensive or harmful content;

·       Share exam answers, assessments or other restricted materials in violation of academic integrity rules;

·       Use the Platform for commercial advertising, political campaigning (unless authorised) or any form of spam;

·       Circumvent or attempt to circumvent security or access controls.

4. Monitoring

User activity on the Platform may be logged and monitored for security, operational and academic integrity purposes, in coordination with ICT Academy and institutions.

5. Consequences of Violation

Violation of this Policy may result in warnings, temporary or permanent suspension of access, disciplinary action by the institution, and/or reporting to relevant authorities, as appropriate.

ACCESSIBILITY AND COMPLIANCE STATEMENT – ICTLMS

1. GIGW Alignment

ICTLMS is endeavors to align with the Guidelines for Indian Government Websites (GIGW), to the extent applicable to an LMS, including aspects of security, performance and usability for government-facing applications.

2. Accessibility

We aim to align with widely accepted accessibility principles such as WCAG 2.1 Level AA, to the extent feasible. This includes features like keyboard navigability, support for screen readers, appropriate colour contrast and readable font sizes.

3. Language Support

The Platform can support English and, where required by ICT Academy, regional languages (for example, Tamil) to improve accessibility and usability for students of government institutions.
